Please read these Terms of Service (“Terms”) carefully before using AskWhiz. By creating an account or using our service, you agree to be bound by these Terms.
Acceptance of Terms
By accessing or using AskWhiz (“the Service”, “we”, “us”, “our”), you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
Description of Service
AskWhiz provides a marketplace of AI-powered WhatsApp bots that technicians and professionals can subscribe to. Each bot is a specialist assistant trained on manufacturer documentation and industry-specific knowledge. Subscribers access a dedicated WhatsApp number for each bot, through which they can ask technical questions and receive instant, accurate responses.
The Service is provided on a subscription basis. Features, pricing, and available bots may change over time. We will notify you of material changes that affect your active subscriptions.
User Accounts
Authentication is handled by Clerk. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must:
- Provide accurate and complete registration information
- Keep your login credentials confidential
- Notify us immediately of any unauthorised access to your account
- Not share your account with others or allow others to access the Service through your account
We reserve the right to suspend or terminate accounts that violate these Terms.
Subscription and Billing
Subscriptions are billed on a per-bot basis. You may subscribe to one or more bots independently. Billing is processed by Stripe. By subscribing, you authorise Stripe to charge your chosen payment method on a recurring basis.
- Monthly subscriptions renew automatically each calendar month.
- Annual subscriptions renew automatically each year at the discounted annual rate.
- Cancellation — you may cancel any subscription at any time through your account settings or via the Stripe customer portal. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
- Price changes — we will give you at least 30 days notice of any price change. Continued use of the Service after a price change constitutes acceptance of the new price.
Acceptable Use
You agree not to use AskWhiz or any bot available through the Service to:
- Send spam, unsolicited messages, or bulk promotional content via WhatsApp
- Harass, threaten, or deceive your customers or any third party
- Violate Meta's WhatsApp Business Policy or any applicable law or regulation
- Attempt to reverse-engineer, scrape, or extract the underlying AI model or training data
- Use the Service for any illegal purpose, including fraud or money laundering
- Impersonate any person or entity, or misrepresent your affiliation with any entity
Violation of this section may result in immediate suspension or termination of your account without refund.
Intellectual Property
All content, software, and materials that make up AskWhiz — including bot knowledge bases, AI models, branding, and the platform itself — are the intellectual property of AskWhiz or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service during the subscription term.
You do not need to provide any content to use the Service. The knowledge bases that power the bots are created and maintained by AskWhiz. Your interactions with bots (messages sent and received) are processed to deliver the Service and are not used for any other purpose.
Limitation of Liability
To the maximum extent permitted by applicable law, AskWhiz and its affiliates, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to AskWhiz in the three months preceding the claim.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. AI-generated responses may contain errors; you are responsible for reviewing bot output before relying on it.
Termination
You may terminate your account at any time by cancelling all active subscriptions and deleting your account via account settings.
We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the jurisdiction in which AskWhiz is incorporated. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
