Please read these Terms of Service (“Terms”) carefully before using AskWhiz. By creating an account or using our service, you agree to be bound by these Terms.
Acceptance of Terms
By accessing or using AskWhiz (“the Service”, “we”, “us”, “our”), you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
Description of Service
AskWhiz is a WhatsApp-first field-service platform for the equipment that keeps businesses running. You place a QR sticker on a machine; a scan raises a service ticket; the platform dispatches a technician and shares live transit; and an AI assistant grounded in the exact machine's manuals triages the fault inside the ticket. When the work is done, the job is signed off on the spot. The AI coverage spans HVAC, refrigeration, and commercial-kitchen equipment and is grounded in official manufacturer documentation.
Features, pricing, and available coverage may change over time. We will notify you of material changes that affect your account.
Qualified Professional Use Only
AskWhiz is intended solely for use by trained, qualified, and (where applicable) licensed or certified trades professionals — including HVAC, refrigeration, and commercial-kitchen-equipment technicians — acting within the scope of their training, certification, and applicable licensure. By using the Service, you represent and warrant that you are such a qualified professional, that you are competent to evaluate the guidance the Service provides, and that you will not rely on the Service in place of your own professional judgment or any required supervision. The Service is not intended for consumers, untrained individuals, or anyone performing work they are not qualified or licensed to perform.
Safety Notice and Assumption of Risk
Servicing HVAC, refrigeration, and commercial-kitchen equipment is inherently hazardous and can involve high-voltage and live electrical circuits, arc-flash, combustible gas, pressurized systems and refrigerants, high temperatures, and moving parts. The Service provides general informational and diagnostic guidance only. It is not a substitute for your own professional judgment, the manufacturer's instructions and service documentation, applicable codes and standards, proper lockout/tagout procedures, or required personal protective equipment, all of which control over anything the Service outputs. You are solely responsible for working safely, for independently verifying any guidance before acting on it, and for determining whether a task is within your qualifications. To the fullest extent permitted by law, you knowingly assume all risk arising from your use of the Service and from any work you perform, and AskWhiz is not liable for any personal injury, death, property damage, or other loss resulting from your reliance on or use of the Service's output.
User Accounts
Authentication is handled by Clerk. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must:
- Provide accurate and complete registration information
- Keep your login credentials confidential
- Notify us immediately of any unauthorised access to your account
- Not share your account with others or allow others to access the Service through your account
We reserve the right to suspend or terminate accounts that violate these Terms.
Billing
AskWhiz is billed per completed and signed ticket. There are no subscriptions, no seats, and no onboarding fees. Each party involved in a ticket is charged one flat fee only when that ticket is completed and signed off. Billing is processed by Stripe. Manufacturers and restaurant groups are billed under separate enterprise agreements at contract rates.
- Per-ticket charge — a charge is raised only on a completed and signed ticket. Open, cancelled, or unsigned tickets are not charged.
- Settlement — if you have saved a payment method, your balance is charged automatically; otherwise you receive a secure pay link. You can review every charge and its underlying ticket in your account.
- Price changes — we will give you at least 30 days notice of any price change. Continued use of the Service after a price change constitutes acceptance of the new price.
Acceptable Use
You agree not to use AskWhiz or any feature of the Service to:
- Send spam, unsolicited messages, or bulk promotional content via WhatsApp
- Harass, threaten, or deceive your customers or any third party
- Violate Meta's WhatsApp Business Policy or any applicable law or regulation
- Attempt to reverse-engineer, scrape, or extract the underlying AI model or training data
- Use the Service for any illegal purpose, including fraud or money laundering
- Impersonate any person or entity, or misrepresent your affiliation with any entity
Violation of this section may result in immediate suspension or termination of your account without refund.
Intellectual Property
AskWhiz owns or licenses all rights in the Service itself — including its software, user interface, design, the “AskWhiz” name and logo, and the original diagnostic and explanatory content that AskWhiz generates — and these are protected by intellectual-property laws. AskWhiz does not claim ownership of the underlying third-party manufacturer manuals, service documentation, or technical specifications from which its diagnostic content is derived; those materials remain the property of their respective manufacturers or other rights holders. The diagnostic and troubleshooting content the Service produces is a transformative, factual synthesis — paraphrased and reorganized statements of fact (such as the meaning of an error code or a troubleshooting procedure) grounded in such source materials — and is not a reproduction or republication of any manufacturer's copyrighted text, which AskWhiz does not distribute. Facts and ideas are not themselves protectable by copyright. Except for the limited right to use the Service under these Terms, you receive no ownership or license in AskWhiz's intellectual property, and nothing in these Terms grants you any rights in any manufacturer's marks or materials.

You do not need to provide any content to use the Service. The knowledge bases that power the AI assistant are created and maintained by AskWhiz. Your interactions with the assistant (messages sent and received) are processed to deliver the Service and are not used for any other purpose.
Trademarks
All manufacturer, brand, and product names and logos referenced in or through the Service — including but not limited to names such as Frymaster, Trane, Manitowoc, and Copeland — are the trademarks or registered trademarks of their respective owners. AskWhiz uses these names only nominatively, for identification, compatibility, and descriptive purposes — to indicate the equipment to which guidance relates. Such use does not imply any affiliation with, sponsorship by, authorization from, or endorsement by any manufacturer or trademark owner. AskWhiz is an independent service and is not affiliated with, authorized by, or endorsed by any of the manufacturers whose equipment it references.
Glasses photo content
When using AskWhiz with Mentra Live or other compatible smart glasses, you are responsible for the content you capture. Do not photograph individuals without their consent. AskWhiz does not perform face detection or blurring; it processes photos as-is for command fulfillment. Photos are subject to the data-flow and retention rules described in our privacy notice.
Limitation of Liability
To the maximum extent permitted by applicable law, AskWhiz and its affiliates, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount paid by you to AskWhiz in the three months preceding the claim.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. AI-generated responses may contain errors; you are responsible for reviewing the assistant's output before relying on it.
AI-generated output may be incomplete, outdated, or incorrect, may not reflect the latest revision of a manufacturer's documentation, and may not account for the specific model, configuration, or field conditions of the equipment you are servicing. Before acting on any output, you must independently verify it against the original equipment manufacturer's current service documentation and applicable codes. The Service is provided “as is” and “as available,” without warranties of any kind, and AskWhiz does not warrant that any output is accurate, complete, current, or fit for any particular repair or diagnostic purpose.
Indemnification
You agree to defend, indemnify, and hold harmless AskWhiz and its officers, directors, employees, and agents from and against any and all third-party claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) any work you perform or fail to perform, or any reliance on the Service's output; (c) your violation of these Terms or of any applicable law, regulation, code, or standard; or (d) your breach of any representation you make under these Terms, including your representation that you are a qualified professional. AskWhiz will provide you reasonable notice of any such claim.
Termination
You may terminate your account at any time by deleting it via account settings. You are responsible for any charges already raised on completed and signed tickets.
We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the jurisdiction in which AskWhiz is incorporated. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
